GALANI’s local Agent sues Defense Ministry for 1.5 mln br


The agent for GALANI ELECTRONICS, Ahmed Sirage alleged that the Ministry of Defense (MoD) failed to deliver approximately 1.544 million birr worth of scrap metal, despite signing a contract agreeing to do so at a hearing held Monday December 23, 2013, at the Federal High Court’s Sixth Civil Bench.
The agent claims to have paid in full, an amount which, nine years ago, was just under 3.085 million birr. He said he paid in two installments on June 28, 2004 and October 7, 2004. Yet, he says that MoD has delivered only 3,783.6 tons out of the agreed upon 7,250 tons of scrap metal. The amount of scrap delivered so far amounts to slightly over 1.54 million birr.
Even though Ahmed Sirage claimed that efforts were made to get the remaining 3466.40 tons of scrap, the Ministry has not complied and no one has been assigned to facilitate the transaction.  
Unsuccessful efforts have been made, including posting a notice requiring the performance of the contract, said the plaintiff.
This, the plaintiff claimed, caused him to incur losses, which he is now asking the Court to redress.  He pledged to provide the exact amount of the damages in the future. He also asked the Court to instruct the Ministry to deliver the remaining scrap metal. In addition, he requested that interest be calculated from the contract starting date and reciprocation for the expenses of the lawsuit.
The Ministry of Defense had announced a public auction in the Addis Zemen gazette, nine years ago, on March 7, 2004 to sell 7,250 tons of scrap metal, the statement of claim presented to the Federal High Court last Monday, affirms.
The Agent pointed to documentary evidence attached to the claim saying that he won the auction to buy the scrap metal and entered into contract for the purchase with MoD on June 8, 2004 following the auction.
